Background

First Stage  In the year 1969, the officer of International Organization of Consumers Unions, a non-governmental organization not involving politics established by uniting of the Consumer Associations of various countries with the principal office at Hague, Netherlands, had convince private sectors in Thailand to establish consumer association. However, it had not been succeeded because Thai private sectors had not readiness for the operation at that time. The International Organization of Consumers Unions had kept on trying, and sent its officer for inducement many times. Until its third effort, Thai private sectors had formed a committee, namely Consumer Study and Promotion Committee, to study the consumer's problems in the year of 1971 with continuous development in private sectors, and also to co-operate with the government sector. In the year of 1976, the government under the administration of M.R. Kukrit Pramoj as the Prime Minister had established a Consumer Protection Board having Pol Gen Pramarn Adireksarn, Deputy Prime Minister, as the Chairman of the Board. However, the Board had dissolved together with the government according to the political path in that age.
 
Drafting of the Consumer Protection Act B.E. 2522 The government, under the administration of Gen Kriangsak Chomanan as Prime Minister, recognized the importance and the need of consumer protection, whereby, the Consumer Protection Board has been reestablished with having Mr. Sompop Hotrakitya, the Deputy Prime Minister, as the Chairman of the Board by virtue of the prime Minister, as well as, to study for seeking permanent measurement to protect the consumer both by substantive law and organization arrangement. In this regard, the consumer protection law has been drafted and proposed by the government to the parliament. Such law has been unanimously approved from the parliament, then, the government has respectfully proposed the draft of the law to his majesty. His Majesty has been graciously pleased to proclaim the enactment of this Act from the day of signing on 30th April 1979 and announced in the Royal Gazette, Volume 96, Part 72, Special Issue, date 4 May 1979, enforceable on the date of 5th May 1979 onward.
 
The Reasons for the Announcement of the Consumer Protection Act B.E. 2522
 
       1. To stipulate the consumer's right;
       2. To stipulate the duty of the business operator;
       3. To effect the establishment of the governmental organization for consumer protection.
 
The reason for the enactment of this Act is that, there are the products and services increasingly offered to the people, while the business operators have applied the advertising and marketing knowledge for sales promotion. This make disadvantage to the consumers since they don't know the market situation and the fact of the product's quality and price accurately and in the appropriate time. Additionally, even though, in some case, there are applicable laws to protect the consumer's right by stipulating the conditions of product's quality and price, or of the advertising business operator, the consumer still has to spend much time and expenses which is unworthy and most of them are unable to spend the time and money for legal proceedings. In some case, the stoppage of the action causing the damage can't be made in time. By that reason, it should enact the law to protect the consumer's right in general by stipulating the duty of trade business operator and advertising business operator for fairness to the consumer, including to effect the establishment of the governmental organization to supervise, monitor, and coordinate among government authorities for the purpose of consumer protection. Therefore, this Act has been enacted.
 
The Establishment of the Governmental Organizations for Consumer Protection
 
       1. The Establishment of the Consumer Protection Board
       2. The Establishment of ad hoc committees
       3. The Establishment of the Office of the Consumer Protection Board
 
The Consumer Protection Act B.E. 2522 has stipulated the establishment of the governmental organizations for consumer protection i.e. Consumer Protection Board, and the Ad Hoc Committees which comprises the Committee on Advertisement and the Committee on labels. This Act has also stipulated the establishment of the Office of the Consumer Protection Board for providing services to infringed consumers, where it is under the supervision of the Secretariat of the Prime Minister for easiness in complying with the government policies and orders of the Consumer Protection Board with having the Prime minister as the Chairman, as well as, for facilitation in coordinating with other authorities in relation to the consumer protection. The government has established the Office of the Consumer Protection Board by enacting Royal Decree of Divided Government in the Secretariat of the Prime Minister B.E. 2522, announced in the Royal Gazette, Volume 96, Part 105, Special Issue, date 1st July 1979. Thus, it is deemed that the Office of the Consumer Protection Board has been established since the date of 2nd July 1979.
