The Government Agencies under the Consumer Protection Act B.E. 2522

The Consumer Protection Act B.E. 2522  is the first law of Thailand which has effect the establishment of government agencies to directly protect the consumer’s right. Since other laws give indirect protection to the consumer due to it has prescribed the control of the business operator which the consumer can’t exercise his/her right to sue against the business operator for criminal case to the court, while, the civil proceedings needs much expense which most consumers are not in the position to proceed the case by their own.
         
The Consumer Protection Act B.E. 2522 has prescribed the establishment of government agencies having power and duty to supervise the business operator not to do the business which infringes the consumer’s right, and to co-operate the actions with other government agencies for consumer protection, as well as, to be a working unit for the consumer exercising his/her right of complaining and requesting for consideration and compensation in case of the occurrence of advantage taking by the business operator.
         
The government agencies established under the Consumer Protection Act B.E. 2522 as amended by the Consumer Protection Act (No.2) B.E. 2541, are as follows:
 
          1. Consumer Protection Board;
          2. Ad Hoc Committees I.E.
               2.1 The Committee On Advertisement
               2.2 The Committee On Labels
               2.3 The Committee On Contracts
          3. The sub committees appointed by  the Consumer Protection Board and Ad Hoc Committees are as follows:
               3.1 The Sub Committee On Legal
               3.2 The Sub Committee On Considering and Scrutinizing Consumer Complaint
               3.3 The Sub Committee On Public Relation
               3.4 The Sub Committee On Surveying Product Quality And Quantity For Consumer’s Right Protection
               3.5 The Sub Committee On Following Up And Scrutinizing Advertisement
          4. The Office Of The Consumer Protection Board

Due to the Consumer Protection Act B.E. 2522 as amended by the Consumer Protection Act (No.2) B.E. 2541 being enforceable throughout the country, there are 2 following organizations established by the Consumer Protection Board in each province to take care of and have the duty in consumer protection:
           - Provincial Consumer Protection Sub Committee (75 provinces)
           - Sub Committee with Power to Settle the Offense Occurring in Other Province other than Bangkok
